6. Right of Withdrawal – Exclusion and Limitations
6.1 Principle
Consumers generally have a statutory right of withdrawal. However, this right of withdrawal does not exist or is restricted for contracts concerning goods that:
• are not prefabricated and
• for the production of which an individual selection or determination by the customer
is decisive or
• are clearly tailored to the personal needs of the customer
(Art. 16 lit. c of the EU Consumer Rights Directive).
6.2 Custom-Made Leather Belts
Our leather belts are custom-made to individual measurements.
• Measurements are provided exclusively by the customer
• A measuring guide is provided in the shop
• Incorrect measurements are beyond our control
Custom-made belts are excluded from the right of withdrawal, even if they do not fit due to incorrect measurements.
6.3 Use of Natural Materials (Leather & Stone)
Our products are made from high-quality natural materials.
Vegetable-tanned leather:
• natural color variations
• individual grains and textures
• slight irregularities
• patina development through wear
• darkening due to light and environmental influences
Genuine stone buckles:
• individual structure, color, and grain
• natural inclusions or veins
• no two stones are alike
These characteristics do not constitute a defect and do not give rise to a claim for return, withdrawal, or complaint.
6.4 Deviations between Product Image and Delivered Product
The product images displayed in the shop are for illustration purposes.
Please note:
• Leather colors are sample sections
• The actual leather area used may vary
• Grain, hue, and surface structure naturally vary
• Monitors and displays may show colors differently
Such deviations do not constitute a defect and do not give rise to a right of withdrawal.
6.5 Non-Custom Buckles (Current Shop Version)
The buckles currently offered are prefabricated models. In conjunction with a custom-made belt, the overall product is nevertheless considered a customer-specific production and is excluded from the right of withdrawal.
6.6 Future Configurator
When using a configurator where:
• buckles are custom-made or
• material combinations are chosen by the customer, these are clearly personalized products.
These are excluded from the right of withdrawal according to EU consumer protection law.
6.7 Individual Craftsmanship
Our products are created through individual craftsmanship, not industrial series production.
• slight artisanal deviations are possible
• these do not constitute a defect
• they are part of the design concept
6.8 Wear and Use
Products that:
• have been worn
• show signs of use
• are individually broken in or shaped
are excluded from exchange and return.
7. Warranty
The statutory warranty rights apply, unless otherwise stipulated in these GTC. Natural material properties, artisanal deviations, and changes due to use do not constitute a defect.
8. Our Liability for Negligence
We are liable without limitation for intent and gross negligence. In cases of slight negligence, we are only liable for the breach of essential contractual obligations and limited to the foreseeable, typical damage for the contract.
9. Applicable Law
The law of the Kingdom of Belgium applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection regulations of the state in which the customer has their habitual residence remain unaffected.
10. Final Provisions
Should individual provisions of these GTC be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
